END USER LICENSE AGREEMENT (EULA)

Please read this End User License Agreement ("Agreement") carefully before using the Regrain application ("Application"). By downloading, installing, or using the Application, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not use the Application.

This Agreement is between BIGCRUNCH TEKNOLOJİ LİMİTED ŞİRKETİ ("Licensor") and the end user ("you" or "User"). It governs the terms of use for the Regrain Application provided to you, which includes AI content generation features (e.g., photos, videos, 3D designs) accessible via www.regrain.co and our mobile application.

1. License Grant

The Licensor grants you a non-transferable, non-exclusive, revocable, limited license to download, install, and use the Regrain Application strictly in accordance with the terms of this Agreement.

2. Use Restrictions

2.1. The Regrain Application is licensed to you for personal use only. Commercial or unauthorized distribution, resale, or any use beyond personal purposes (e.g., creating content for third-party commercial projects without permission) is strictly prohibited.

2.2. You agree not to:

• The QREasy Application is licensed to you for personal use only.
• Modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application.
• Use the Application in any manner that violates any local, state, national, or international law, including laws related to intellectual property or data privacy.
• Share, distribute, sublicense, or lease the Application to any third party.
• Use AI-generated content in ways that breach the prohibited uses outlined in our Terms of Service (e.g., creating harmful or illegal content).

3. Subscription Model and License Term

License Duration: The license granted to you is valid as long as you maintain an active diamond balance or account. If your diamond balance expires or your account is terminated, your access to premium features will be revoked, though basic features may remain accessible unless otherwise stated.

4. Updates and Changes

The Licensor may periodically provide updates or upgrades to the Application. Such updates may modify or delete certain features and functionalities (e.g., adjusting AI model capabilities or diamond pricing). You agree that the Licensor has no obligation to:

• Provide any updates or upgrades.
• Continue to provide or enable any specific features through updates.

5. Privacy Policy

Your use of the Application is also governed by the Regrain Privacy Policy, which is incorporated into this Agreement by reference. You agree that any personal data collected by the Application (e.g., uploaded media, usage data) will be handled in accordance with the Privacy Policy. You can view the full Privacy Policy here.

6. Limitation of Liability

To the maximum extent permitted by law, the Licensor is not liable for any direct, indirect, incidental, special, or consequential damages that arise from the use or inability to use the Regrain Application, including, but not limited to:

• Damages for loss of profits, loss of data, or loss of AI-generated content resulting from the use of the Application.

7. No Warranties

The Regrain Application is provided "as-is" and without any warranties of any kind. The Licensor makes no guarantees that the Application will operate without interruptions, errors, or security issues. The Licensor does not warrant that:

• The service will meet your requirements.
• The service will be uninterrupted or error-free.
• Any errors in the Application (e.g., AI generation inaccuracies) will be corrected.

8. Termination

This Agreement will remain in effect until terminated by you or the Licensor. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Regrain Application and uninstall the Application from your device.

9. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Turkey. Any disputes arising under this Agreement shall be resolved in the courts of Istanbul, Turkey.

10. Amendments to this Agreement

The Licensor reserves the right to amend or modify this Agreement at any time. Any changes will be posted in the Application or communicated via email or push notifications. Continued use of the Application after any amendments will constitute acceptance of the modified terms.
